Regulations
DMD prides itself in maintaining only quality distributors to distribute our products. Some of the over-the-counter (OTC) medications that DMD markets contain List 1 Chemicals that are regulated by the Drug Enforcement Administration (DEA). These products contain ingredients that can be used in the production of methamphetamine. Therefore, in order to reduce the likelihood that DMD's List 1 Chemical products show up in the illicit trade, we have set up a comprehensive compliance program. The following is a sampling of some of the steps required by our distributors; in-depth regulations are available in the information packet.
- Retailers wanting to buy Ephedrine or Pseudoephedrine must understand that the sales limit to a retail location must be no more than 144 units per month.
- All retailers are required to be given a pamphlet explaining the retailer's obligations under The Methamphetamine Control Act of 1996. These pamphlets are supplied by DMD® Pharmaceuticals.
- Controlling inventory to each retailer that sells List 1 Chemicals to ensure there is no problem with diversion.
These are just a few of the steps that are required to buy List 1 Chemicals such as Ephedrine from DMD Pharmaceuticals®. Other distributor requirements include maintaining a DEA license and a state license for OTC Pharmaceuticals, submitting an authorized purchasing agent list and signing a Distributor Sales Contract, among other materials. DMD will help each distributor with compliance, sales, and promotion of its products.
The Methamphetamine Control Act of 1996 imposed requirements on the chemical industry. However, the involvement of private industry and the public should not be limited to the laws enacted by Congress. The vast majority of the industry recognizes and supports the idea that the responsibilities of the chemical industry extend beyond the letter of the law. We must actively support efforts to stop the flood of clandestinely-produced drugs which plague our nation. We urge each firm to be vigilant and to become a partner with DMD in preventing the diversion of chemicals to illegal drug production.
